Note: The REALTOR® Exclusive MLS Compliance Rule applies to residential real estate with signed exclusive listings. These listings must be advertised on MLS, with addresses included. REALTORS® can no longer share signed exclusive residential listings privately among themselves in different companies, throughout the industry or with the public.

While we at ICIWorld hope that this rule will one day be reconsidered, for now, we are required to comply. When dealing with residential real estate:

No addresses can be shared when networking unsigned residential opportunities on ICIWorld.

Once the listing is signed, it must be placed on MLS within 1 to 3 days (depending on the association or board in the USA and Canada).

We suggest following all rules of CREA and NAR to avoid violations, as non-compliance can result in warnings and potential loss of MLS privileges.

How We Handle Unsigned Residential Opportunities on ICIWorld

ICIWorld enables networking of residential information without providing addresses. Here’s how we operate:

When you receive a call from an interested buyer, you can inform them that the property will be listed on MLS after the listing is signed.

At that point, the buyer can be invited to your first open house, adhering to RECO guidelines that require written consent from the owner before sharing the address.

My proposal suggests that every broker worldwide should have comprehensive information available on their respective websites, making them the primary destination for real estate buying and selling information. This would encompass not only MLS data but also additional information not covered by MLS. I refer to this concept as “ILS,” or Information Listing Service, which functions similarly to classified ads.

With ICIWorld, for the first time, Realtors can share their information on each other’s websites, creating a network for real estate buying and selling opportunities. While MLS handles signed listings, ILS (an information listing service) focuses on facilitating connections and opportunities in the real estate market. ICIWorld empowers numerous websites and web pages on the Internet, serving as the IDX link that brokers can integrate into their own websites. This setup ensures that the website owner, typically a member, receives inquiries and leads.

So really ICIWorld is like a real estate classified ad service where you can put as much or as little information in the message as you wish. We call it networking. And of course brokers and salespeople also advertise their listings. Think of ICIWorld in one sense like a world real estate classified newspaper, that each broker can have on their own website. The benefits are enormous for brokers and salespeople as you should direct every one of your prospects and clients to your own website. Now the new Realtor MLS Compliance Rule applies to residential real estate in Canada Jan. 3, 2024. If you have a listing for a residential home, you are not allowed to advertise it to the public unless you put it on MLS. If it is a listed MLS residential home you can place that on ICIWorld as a member of ICIWorld.

If you do not have a listing, you can netwok that informaiton on ICIWorld. But you cannot give the address to anyone. Tell people that once you have it listed you can call them back and they can be one of the first people to see the home. When you list it, you must put it on MLS.

As MLS is so important all our members must and should follow the rules. You can try to get them to reconsider the rules but until it is changed every Realtor must abide by them.

This does not affect Wants for residential homes. Everyone can always place Wants for residential homes.

This rule does not apply to commercial real estate or any other kind of real estate.

It is already a rule in the USA by NAR. If you are not a member of NAR or CREA the rule does not apply.

Networking information on ICIWorld without a signed listing is stil permissable as long as you do it correctly.

This is the information age and networking information is effective when done properly and in accordance with your real estate licensing body. For instance: you must have the consdent of the owner in writing if you are going to give an address of a property for sale to someone or identify a property. But if you do not identify the property or give an address you can network the opportunity. IE: Markham, Restaurant, $700K making money. There si not signed listing with the owner but a verbal agreement to pay commission if the broker finds a buyer.

What is classifed advertising?

Dec. 4, 2023 How to handle new CREA and NAR Realtor MLS Compliance Rule. First: The new MLS rule does not apply to commercial or residential income producing property and other certain exemptions. You can still advertise and market residential MLS listings. You can network information for residential. But once you have a signed listing it must be placed on MLS within 3 days.

Residential real estate, advertising MLS listings, and networking information before a listing can do this.

HOWEVER, IF YOU ARE A REALTOR, as of January 4, 2924, in Canada by decree of CREA, a; ready applicable for members of NAR in the USA, if you have a SIGNED RESIDENTIAL LISTING if it is exclusive, MUST BE PLACED ON MLS within three days of signing.

Commercial real estate is not affected by the new CREA MLS rule. In Canada, residential income property is unaffected, and other exemptions exist, such as assignments, new home developments, etc.

The following rule only applies to residential real estate, not commercial.

The new rule does not apply to industrial, commercial, investment real estate, land, business opportunities, recreational property, apartment buildings, residential income property, or other real estate.

You can advertise signed residential real estate listings as long as they go on MLS.

and network all the exemptions for exclusive residential real estate signed listings.

Suppose you do not have a signed residential listing. In that case, you can network residential real estate opportunities just like commercial ones but must do it without ever giving an address or identifying the property. RECO Code of Ethics. However, once you have a signed listing, to show the property, you must place the listing on MLS. You tell people you will place their name on a list, and they can be one of the first ones to an open house once you have a signed listing, which, of course, must be placed on MLS.
