Explanation of Exclusive Information and Networking
Networking real estate information is something that all real estate brokers and salespeople on earth can improve dramatically that can improve your bottom line within 90 days of joining. In an appointment we will share with you how easy it is to do.
Every real estate broker and salesperson has MLS on their website. There are choices for residential and commercial real estate. If a residential salesperson gets a lead for a commercial property or business, they would typically refer the lead to a commercial real estate or business agent.

The same is true for an ILS information listing service. Every real estate broker and salesperson can have Exclusives on their website. Choices for commercial real estate and businesses for example, the salesperson would typically do a referral to a commercial real estate or business agent.

Our definition of exclusives is any opportunity in real estate or business that is not on MLS either because the broker cannot get a signed listing at this moment or because it is preferable for many legitimate reasons.

We have been doing this on the Internet since 1994, successfully following all the rules of RECO, NAR and CREA.
We follow the RECO guidelines that you must have the consent of the owner in writing if you are going to give an address or identify a property for sale. One of the things all brokers and salespeople do, is network opportunities in order to eventually get a listing signed. That is what we do on ICIWorld. It actually is sharing confidential information in a collaborative way. d When NAR passed the Realtor Compliance exclusive rule for MLS they did not realize or were aware that there is a group of REALTORS who are using a service that actually shares exclusive information. Making the opportunity available publicly. In many cases a broker or salesperson cannot get a signed listing yet the property is available. The owner even tells the broker bring me a buyer and I will pay you commission. We get a verbal agreement to network the information but we do not provide an address. When interest is demonstrated, and someone wants to see the property, then we get a 48 hour exclusive listing agreement signed properly and then do a showing and conduct a potential sale.
An information listing service like ICIWorld can do this whereas an MLS service cannot because you cannot put anything on an MLS service unless you have a signed listing. That is why we feel that all real estate boards should adopt ICIWorld as their networking service. That way brokers have both services they can offer.

There is some concern over the REALTOR compliance rule for RESIDENTIAL EXCLUSIVE SIGNED LISTINGS MUST GO ON MLS WITHIN 3 DAYS. Our recommendation to all our members is to follow the rules.

As a networking service, in our case, if the residential opportunity is not signed listing, we network the information. However with the intention that the moment it is signed and advertised publicly then it must be put on MLS.

Remember, networking information is not a signed listing. It is networking. We are in an information age. No property addresses or identities are disclosed. That would be in contravention of the code of ethics and standards of business practice.

Members of ICIWorld network information in a public fashion, sharing exclusive information with each other and the public. Unlike what some leaders in the industry say, that exclusive information is not shared. We share real estate opportunities much similar to MLS but in a different way. Many leaders in the real estate industry are not aware that we share exclusive real estate and in residential real estate both NAR and CREA have chosen to not allow an exclusive listing to be shared on this platform unless it is on MLS. This limits opportunities for brokers because many people do not want their information on MLS in such a public fashion as MLS. It works for 90 % of the people but not other 10% (not really sure of the numbers). In our opinion it limits opportunities for residential brokers to network exlusive opportunities.

The remaining question is, can a broker who wants to network an opportunity that is not a signed listing that is residential, can they place that information on ICIWorld, but once they get a signed listing then they must put it on MLS.

All brokers and salespeople in the world can advertise and network commercial real estate opportunities with no problem. The foregoing applies to residential only called the Realtor Compliance Rule. CREA applies it effective Januayr 8, 2024.

You could lose your MLS abilities and your present real estate board and membership status in NAR and CREA if you now advertise an exclusive residential listing without putting it on MLS. Freedom of choice is gone for the homeowner and the Realtor. Our polls showed 75% against the motion. But they say the leaders went to the annual meeting AGM for CREA in Ottawa in May, 2023, many undecided, but then voted 90% in favour without any input from the rank and file like us, and other input from brokers like us. We deal daily with the rank and file and they were not aware until basically the last moment. There was no cross Canada poll which outlined the merits of the For And Against dicussions.

We choose however to follow the guildelines. Thank god it does not apply to commercial.

In our opinion they totally missed out on considering a third option, sharing exclusive information such as we do on ICIWorld so all the Realtors have access to the exclusive opportuniities like we do on ICIWorld. At the moment they voted this was not an option. At the moment they voted they assumed that all exclusive information is not shared but kept in the back pocket of a Realtor. The Realtor MLS Exclusive Compliance Rule, as applied by NAR and CREA members, only applies to residential homes.

It does not apply to anything else, such as industrial, commercial and investment (ICI) real estate, land, farms, apartment buildings, business opportunities, office buildings, shopping centers, recreational property, etc.

There exclusions to the residential rule for homes such as residential assignments, pre-construction, new homes, income property, etc. Check with your local board or association.

Although our poll showed 75% of Realtors against this rule, we will follow the rule 100% for signed residential exclusive listings and insist they be put on MLS whether the owner or professional real estate representative disagrees for various legitimate reasons.

We shall insist a residential signed exclusive listing must not be placed on ICIWorld for worldwide marketing. However, if it is not signed and remains confidential they can network the information, but once a listing is signed to show it, it must be placed on MLS within 1-3 days depending on which state or province and association you belong to.

Regarding residential signed exclusive listings by a NAR or CREA REALTOR member, they must be put on MLS within 1-3 days, depending on the province, state, and real estate board you belong to.

Concern has been expressed by some regarding the MLS Compliance Rule for Residential Listings as implemented by NAR, The National Association of Real Estate, with approximately 1.5 Million salespeople out of 5.7M in the USA, and with CREA, The Canadian Real Estate Association. with approximately 160,000 members out of 250,000, approximately. These figures are constantly changing, so I stand to be corrected and would appreciate any updates.

This does not prevent registered real estate REALTOR professionals on ICIWorld from placing their residential Wants, i.e., what people are looking for, marketing their real estate board residential MLS listings, or networking residential information that is not a signed listing without an address or identifying the property, which makes it confidential. However, once you get a signed residential listing from the owner, it must be placed on MLS within 1-3 days, depending on which real estate board you belong to in the USA and Canada.

As a side note but important in my opinion. This MLS Exclusive Rule was to force the owners to share their information, give access to the world, and force the Realtor to put it on MLS because others act in what they think is in good faith as the only reason to achieve the highest and best price. Others to make it shareable. New technology on ICIWorld makes networking these opportunities shareable with the industry. Exclusive listings are networked on the ICIWorld Global Real Estate Networking App and on ICIWorld.com and hundreds of websites we have been providing for 29 years with now over $1 Billion in Sales by member brokers, providing more choice for the public, and contributing to the GDP with every sale. Sales by the way that were achieved by networking information confidentially before a signed listing was put in place. The only difference now is for residential real estate, we carry on networking, but when an interest is shown and s signed listing is put in place, if you continue to advertise it publicly, it must be placed on MLS. We recommend that all our real estate broker and salesperson members follow your real estate board’s directions.

There are exclusions for residential from the exclusive MLS compliance rule that applies to residential homes only, with exclusions for residential income and investment property, assignments, pre-construction, new homes, and other exclusions that local real estate boards may enact.

The Realtor MLS Exclusive Compliance Rule only applies to residential and does not apply to anything else, such as industrial, commercial and investment (ICI) real estate, land, farms, business opportunities, office buildings, shopping centers, recreational property, etc.

Our position is that we follow the guidelines of NAR and CREA. However, in the case of ICIWorld, which is an ILS Information Listing Service, we network information in many cases before a listing is signed. if you do not have a signed residential listing, you cannot put it on MLS. Secondly and vitally important, when we network information we do not provide the address or identify the opportunity. This is a requirement of RECO for instance The Real Estate Council of Ontario which says you must have the consent of the owner in writing if you are going to give an address of a property for sale to someone or identify a property.
